Oklahoma Supreme Court Rules on Mask Mandates

Breaking! The Oklahoma Supreme Court rules school districts, not the governor or legislature, should decide on mask mandate. They ALSO rule that mask mandates must be an opt-in option and therefore, parents who choose not to mask do not have to opt-out as demonstrated by districts like Oklahoma City Public Schools who made parents opt out if they did not want their child wearing a mask.

The greatest level of parental right is opt-in so this was a win!

Schools still have to meet all criteria set forth in SB 658  and the mask issue must be brought up at each meeting and take parent input.

Again, the only part of the original bill that the Oklahoma Supreme Court removed was that in order for schools to mandate masks the Governor must declare a state of emergency first. In case you missed it, Gov. Kevin Stitt said repeatedly he would not declare another state of emergency over the COVID-19 pandemic. The court said this meant the law acted as a “state wide prohibition for masks for public schools.”

Now that SB658 has been clarified, Oklahoma schools should obey the entire law. We are still getting reports that schools are telling students, especially 7th graders, that they can’t return to school or play sports without taking another Dtap/Tdap.

SB 658 clearly states that all school MUST provide opt-out information on all vaccine “requirements”.

Action: Parents or their attorney may write a letter to the school district or have them also write a litigation threat letter.

OK Supt of Ed Candidate Jena Nelson: Endorsements and Involvement in DEI / CRT

The Oklahoma Superintendent of Education race is being reported as a close race.  Republican candidate Ryan Walters has made his priorities known, but what do we know about Democrat candidate Jena Nelson besides her opposition to vouchers?

Neither candidate, if elected, would have the authority to enact or prevent a voucher program.  The legislature has the responsibility for making this decision.  But the person elected would have great influence over curriculum in public schools.

Jena Nelson Involvement with CRT / DEI Policies

 

Per OCPA link below, Jena Nelson was a member of Deer Creek Public Schools Diversity and Inclusion Committee.  On Feb. 12, 2022, Nelson claimed that CRT is not part of Oklahoma schools and dismissed concerns that many CRT concepts are now being relabeled as “social emotional learning” (SEL).

The Deer Creek school district has hired the Oklahoma Center for Community and Justice (OCCJ) to provide up to 13 workshops whose objectives include a focus on “diversity, inclusion, implicit bias, and inclusive leadership.”

The OCCJ blog states that several of the organization’s programs “address critical theories by seeking to interrupt the automatic consciousness that determines what is ‘right’ or the ‘truth.’ For example, both young people and adults who partake in OCCJ programs are encouraged to examine their identities, seeking examples of both privilege and lack of privilege.”

Is your school district following the law?

Oklahoma allows vaccine exemptions for school children based on personal, religious, and medical reasons. In addition to exemption law, there is a more recent section of law that requires school districts to inform parents of exemption options.

Per SB 658, which went into effect July 1st 2021, 

The State Department of Education shall provide and ensure that each school district in this state provides, on the school district website and in any notice or publication provided to parents regarding immunization requests, the following information regarding immunization requirements for school attendance:
“For school enrollment, a parent or guardian shall provide one of the following:
1. Current, up-to-date immunization records; or
2. A completed and signed exemption form.” 

Is your school following the law?

We have received an unprecedented number of reports this year of schools that are violating state law. We need your help to make sure that this important section of state law is followed. We have included sample email and phone scripts as well as contact information to make this as easy as possible!

While we could feel defeated, we need to use this to motivate ourselves to volunteer and donate. We have beat OSMA before, but we had a literal army of fired up mama bears! Many of our members seem to have gotten complacent. Speaking face to face with people as a grassroots volunteer beats mailers and ads nearly EVERY TIME! But we have to have the manpower and money to get it done. The race for Attorney General is really starting to heat up. Gentner Drummond has a “dark money” group sending hit pieces out on John O’Connor, and O’Connor is swinging back. Watch his campaign ad here.

Genter Drummond claims that the Biden donation was from his wife, saying that ‘his wife “got mad” and made the contribution using a joint credit card but that she “immediately asked for a refund and got the money back.”‘ [Tulsa World] Update: Watch Drummond’s response to a question about his donation here.

FEC records show that Drummond also gave:

  • $1,000 to Democrat Matt Silverstein’s 2014 campaign against Jim Inhofe
  • $1,450 to Democrat John Olson’s 1st District congressional campaign in 2012 (Jim Bridenstine defeated him in the general election).
  • $2,500 to Democratic Congressman Dan Boren from 2004 to 2010.
  • $1,000 to Democrat Brad Carson’s campaign against Tom Coburn in 2004 (given after Coburn won the GOP primary)

Searching the Oklahoma Ethics Commission, one can find that Drummond has given to the following Democratic candidates since 2015:

  • $500 to Cathy Ross (challenger to GOP State Rep. Sean Roberts in 2016)
  • $500 to State Rep. John Waldron in 2018
  • $250 to Andy Richardson (lost to Republican Sheila Dills in 2018)

What can we do about the W.H.O?

On January 18th, 2022, the United States Department of Health and Human Services proposed amendments to the IHR. These amendments give control over the declaration of a public health emergency in any member state to the WHO Director-General – even over the objection of the member state. The Director-General communicated the text of the proposed amendments on 20 January 2022, via a circular letter to State Parties.

The proposed IHR amendments also cede control to WHO “regional directors,” who are given the authority to declare a Public Health Emergency of Regional Concern (PHERC). Moreover, the proposed amendments allow the Director-General to ring an international alarm bell, by unilaterally issuing an “Intermediate Public Health Alert (IPHA).”

This level of control—over daily activities and necessary supplies to sustain life—should not even rest with our own government, let alone an unelected, foreign enforcement body! It is time to pull out the stops and fight to restore independence and freedom
